of the public in 2007, under Section 53 of the Wildlife and
Countryside Act 1981. The application seeks to record a public
footpath over St Catherine’s Hill, running between Garnier
Road and Five Bridges Road, Winchester.
1.2. It is considered that the documentary and user evidence
reviewed is insufficient for it to be inferred that, on the balance
of probabilities, the public has acquired a right of way on the
claimed route, and it recommended that the application be
refused.

1.1. Hampshire County Council has been
approached by local residents and elected members with a view to
improving the surface of a metalled path running between Winchester
Bridleway 5 and Coppice Close. The route has existed since the
surrounding Teg Down development was built during the 1960s, but
was not subsequently adopted as a publicly maintainable highway. As
a result, no authority currently has any duty (or power) to
maintain the surface of the route, and in recent years some
sections of the route have fallen into disrepair, in particular the
right-angled junction at the eastern end of the route, which is
prone to flooding in wet weather.
1.2 There is no known owner of the land over which the route runs
(the company registered as the freeholder has been dissolved),
nobody is in a position to dedicate public highway rights over the
route, and so to record the route as a public right of way would
require rights to either be recorded via a Map Modification Order,
based on evidence of use (which would be a time-consuming process),
or by a creation order under Section 26 of the Highways Act 1980.
It is considered that the latter would be a more efficient means of
recording the route on the Definitive Map.
1.3 Because the route in question runs between an existing
bridleway and an adopted road, officers have consulted on the basis
of recording the route as a bridleway, so as not to render the spur
of Bridleway 5 a legal cul-de-sac for cyclists. Further, the
consultation revealed that the route is (and has been) regularly
used by cyclists. Whilst recording the route as a bridleway would
also enable the route to be legally used by equestrians, the urban
setting of the path makes this scenario unlikely.
1.4 Winchester City Council, user groups and local residents were
consulted on the proposal. No objection was raised, with support
coming from some local residents and the representative of Cycling
UK.

of Alton Footpath 64 has revealed that the Definitive Map of Public
Rights of Way is in error, and requires modification. A full report

record.
1.2 Officers have established that the alignment of the path
currently recorded does not reflect the route that has been
available on the ground for over a century. The decision has
therefore been made to make a Definitive Map Modification Order to
correct the alignment of the path.

district/borough areas in the future if required.

of pay-and-display, on-street parking
in Gosport to provide an appropriate mixture of on-street and
off-street, paid for parking, to meet established County Council
policy objectives.
That the Executive Member for
Environment and Transport approves the termination of current
district/borough council agency arrangement for civil parking
enforcement and authorises the serving of appropriate notices for
this change to come into effect no later than 1 April 2020, with
alternative arrangements for a civil parking enforcement service
put in place to provide a consistent countywide service in
accordance with County Council policy objectives.
That the Executive Member for
Environment and Transport delegates authority to the Director of
Economy Transport and Environment to work with District and Borough
Councils to explore alternative arrangements for a consistent
countywide civil parking enforcement service, with confirmation of
decisions in respect of potential, revised agency agreements
required by 1 April 2019 to allow sufficient time for alternative
arrangements to be established.
That the Executive Member for
Environment and Transport approves the development and
implementation of a system for bus lane enforcement, as part of
revisions to the enforcement service in the county.
