All Members who believe they have a Disclosable Pecuniary Interest in any matter to be considered at the meeting must declare that interest and, having regard to Part 3 Paragraph 1.5 of the County Council's Members’ Code of Conduct, leave the meeting while the matter is discussed, save for exercising any right to speak in accordance with Paragraph 1.6 of the Code.  Furthermore all Members with a Personal Interest in a matter being considered at the meeting should consider, having regard to Part 5, Paragraph 4 of the Code, whether such interest should be declared, and having regard to Part 5, Paragraph 5 of the Code, consider whether it is appropriate to leave the meeting while the matter is discussed, save for exercising any right to speak in accordance with the Code.

The minutes of the last meeting were reviewed and agreed.

To consider a report from Assistant Director of Waste & Environmental Services regarding two variations to conditions at Roke Manor Quarry in Shootash.

Variation of Condition 2 (time limits) of Planning Permission 15/00826/CMAS – to extend the time within which restoration of Roke Manor Quarry is required to be completed (No. 24/00736/CMAS)

and

Variation of Condition 2 (time limits) of Planning Permission 10/02615/CMAS - to extend the time within which restoration of Roke Manor Quarry is required to be completed (No. 24/00739/CMAS) at Roke Manor Quarry, Salisbury Road, Shootash, Hampshire SO51 6GA

The Committee considered a report from the Assistant Director of Waste & Environmental Services (item 6 in the minute book) regarding two applications for Roke Manor Quarry in Shootash.

The officer summarised the proposals and Members were shown aerial photographs of the site and local area as well as restoration plans for consideration. It was highlighted that a liaison panel had met and subsequent conditions arising from that were included in an update report, which had been published. The update report also included corrections to paragraphs 117 and 47 of the main report.

The Committee received a deputation from Rob Storey on behalf of the applicant, who spoke in favour of the applications. Following a question after the deputation, it was confirmed that the silt extracted was higher than anticipated and more time was needed to process the by-product.

Officers confirmed that access of the A27 would continue following the extension until the restoration had been completed.

RESOLVED

1.    Planning permission was GRANTED for planning application 24/00736/CMAS to extend the time within which the total site restoration of Roke Manor Quarry is to be completed, to 15 years from the date of commencement of the bell mouth access onto the A27, subject to:

a.    The update report

b.    The conditions listed in Appendix A1

c.    The deed of variation to the existing Section 106 legal agreement (to extend the long-term management of the adjacent woodland and the restored land under the haul road causeway), which will then link the end date of the long term woodland management plan to when the aftercare period is signed off by the development, and;

d.    A deed of variation to the existing Section 106 legal agreement will update the planning application reference so that it can continue to bind the varied permission sought.

2.      Planning permission was GRANTED for planning application 24/00739/CMASto extend the time within which the total site restoration of Roke Manor Quarry is to be completed, to 15 years from the date of commencement of the bell mouth access onto the A27 subject to:

To consider a report from the Director of Universal Services regarding an application for a Lawful Development Certificate at Aldershot Recycling Facility in Aldershot.

This item was deferred to a future meeting.

To consider a report from the Director of Universal Services regarding a review of the Local Enforcement Plan.

The Committee considered a report from the Director of Universal Services (item 8 in the minute book), which presented updates to the Local Enforcement Plan for Committee comment and approval.

The updates were summarised, which followed changes to national guidance, enforcement powers and monitoring responsibilities introduced by the Levelling Up and Regeneration Act 2023 as well as the new Biodiversity Net Gain (BNG) requirements under Schedule 14 of the Environment Act 2021.

Regarding section 5.3 of the plan, Members proposed enforcing that despite not obtaining necessary planning permission was not a legal offence, it was still a planning breach.

Members praised officers for the diligent monitoring and enforcement work and mitigation work that took place across the County, noting that there had been no court proceedings required for 15+ years

The contents of the report and the associated draft Local Enforcement and Site Monitoring Plan were approved, subject to delegated authority for officers to address formatting and style requirements before publication.
