Apologies were received from Councillor Keith House and Councillor Roger Price. Councillor Tim Groves and Councillor Wayne Irish attended as deputies.

All Members who believe they have a Disclosable Pecuniary Interest in any matter to be considered at the meeting must declare that interest and, having regard to Part 3 Paragraph 1.5 of the County Council's Members’ Code of Conduct, leave the meeting while the matter is discussed, save for exercising any right to speak in accordance with Paragraph 1.6 of the Code.  Furthermore all Members with a Personal Interest in a matter being considered at the meeting should consider, having regard to Part 5, Paragraph 4 of the Code, whether such interest should be declared, and having regard to Part 5, Paragraph 5 of the Code, consider whether it is appropriate to leave the meeting while the matter is discussed, save for exercising any right to speak in accordance with the Code.

To confirm the minutes of the previous meeting

The minutes of the last meeting were reviewed and agreed.

It was confirmed that three deputations had been received along with one County Councillor who had registered to speak.

To receive any announcements the Chairman may wish to make.

The Chairman confirmed that the application for the Alton ERF had been deferred until a later date.

To consider a report from the Head of Strategic Planning regarding variation of condition 2, 9 and 10 of Appeal decision reference PP/Q1770/A/11/2161324 (Planning Application Reference: 10/02712/CMA) to reshape and improve the existing peripheral north eastern landscape bund to facilitate enhanced screening from wider views into the site and improve biodiversity on the site's periphery and to accommodate a temporary wash plant operation in the southern section of the site for a period of twelve months only at Salvidge Farm, Bunny Lane, Timsbury SO51 0PG (No. 21/00588/CMAS) (Site Ref: TV066)

The Committee received a report from the Head of Strategic Planning regarding a revised application for variation to conditions at Salvidge Farm, following a previous refusal.

It was acknowledged that a site visit had since taken place and further discussions had resulted in the Environmental Health Officer no longer objecting to the proposal.

Committee was shown a location plan of the area and the relationship of the site to nearby developments and the road network. The areas subject to noise conditions were also highlighted to Members. An update report had been published and provided to Committee, which covered minor changes to the report and consultations as well as the Conditions.

The Committee received two deputations on this item, along with the local Member, Councillor Nick Adams-King. Councillor Bob Davis, Chairman of Timsbury and Michelmersh Parish Council shared his concerns regarding noise from the wash plant on site as well as the effect of the site on the landscape. It was felt that whilst the new conditions did address concerns to an extent, there was still potential for them to be breached. It was also felt that the bunding and landscaping would not mature in the 12 months proposed for the application timeframe.

Michael Woodhall and John Palmer spoke on behalf of the applicant. Mr Woodhall emphasised the importance of the site and it’s history and Mr Palmer expanded how the shortage in aggregates meant that the site was crucial. Mitigations had been put in place and a commitment had been made for 320 plants for landscaping, including already fully grown plants that would provide immediate benefits. The Committee was also reminded that there were other sources of noise in the area and not all could be associated with this particular site.

Councillor Nick Adams-King thanked officers for their work on the application and the applicant for the valuable site visit that took place. Councillor Adams-King shared his concerns regarding the application coming back for further permission after the 12months had ceased and also of the suitability of the landscaping in the winter.

During questions of the deputations, the following points were clarified:

·         A liaison panel had been suggested and this would be looked into by the applicant

·         It was accepted that it couldn’t be guaranteed that there would never be noise from the site

·         40dB was felt to be an acceptable level

·         40%-50% of the planting had already been started and established to assist with the noise and visual impact of the site

The Committee considered a report from the Head of Strategic Planning (item 7 in the minute book) regarding an application for Blue Haze in Ringwood.

The site was one of three landfills remaining in the south of England and it was anticipated that it would run out of capacity by 2026-27, and the amendment and reprofiling would allow more space as well as time for restoration. The Committee was shown drone footage of the site as well as photos and video of the site at ground level. An update report had been published and provided to Committee, which covered minor changes to the report as well as the Conditions.

The day-to-day running of the site and end date would remain unchanged.

The Committee received a deputation from Simon Mckee and David Bridgwood on behalf of the applicant who summarised the proposals and reasoning behind them and how it was the most sustainable and least intrusive way of assisting the ongoing work. When questioned, the applicant confirmed that the restoration would be a mix of heathland and woodland.

In debate, Members were encouraged by the plans for restoration but it was agreed that the amount of waste going to landfill was stillquite significant and it was crucial that the County continued ongoing work in reducing waste.

RESOLVED

Planning permission was granted subject to the update report, conditions listed in Appendix A and the Section106 obligations (S106) set out in the S106 agreement dated the 30^th April 1999 and as varied by the deed of variation dated 4^th of November 2020 that includes obligations for :

(i)     Lorry routing agreement restricting the use of Harbridge Drove and the B3081 northwards, except for local deliveries;

(ii)    Management Agreement for Nature Conservation and the provision of footpaths/access for public recreation;

(iii)  Section 106 Agreement relating to off-site heathland within Plumley Wood; and

(iv)  Improvements to Bakers Hanging Junction, the realignment of part of the  B3081 and dedication of land as highway.
