This is a proposal for the creation by order
of public footpath rights in Baughurst, under Section 26 Highways
Act 1980. The proposed footpath is 1.5 metres wide, running between
post and rail fencing to the north-west of the definitive line of
Baughurst Footpath 13b. The proposed route has been in use in
favour of the definitive line for over 10 years.
It is also proposed that the authority is given for an
extinguishment order under Section 118 of the Highways Act 1980 for
that part of Baughurst Footpath 13b that will no longer be needed
for public use as a result of the creation.

Decision:
Hampshire County Council has a duty to
determine applications made under Section 53 of the Wildlife and
Countryside Act 1981.
An analysis of the user and documentary evidence set out in the
background report concludes that although there is some conflicting
evidence, when taking all the evidence together, it provides a
reasonable allegation of dedication under common law. Officers
consider that the bridleway should be recorded as 3.5m wide in line
with the aerial photography and mapping during the period of
claimed use.

fee introduced on 1 October 2020 (and updated 1 July 2023), to
support the efficient monitoring and management of planning
obligations and developer contribution funds, is increased to
£660 per obligation from 1 May 2024.
2. That the planning obligations monitoring fee of £660 per
obligation is subject to review after 12 months, to ensure it
continues to appropriately fund the monitoring and management of
planning obligations.
3. That the monitoring fee is subject to a capped maximum fee
corresponding to 20 obligations (i.e. £13,200) per
agreement.

That a traffic order be implemented under the
Road Traffic Regulation Act 1984 (RTRA), the effects of which will
be to resolve several anomalies contained in the “The
Hampshire (Winchester Street, Botley) (Prohibition of Driving)
Order 2023” specifically to allow access to residents of
Winchester Street and formalise pedal cycle exemptions.
This order will revoke and reinstate “The Hampshire
(Winchester Street, Botley) (Prohibition of Driving) Order
2023” in its entirety save for the above-mentioned
changes.
