In 2013 Hampshire County Council, in its
capacity as Commons Registration Authority for Hampshire, received
an application under Section 15 of the Commons Act 2006, to
register land at Borough Hill, Petersfield, as a town or village
green (see Appendix 1 for a location map).
Due to a backlog of applications, this matter was not picked up for
investigation until 2022. Prior to the formal advertising of the
application, the owner of the majority of the application land,
Petersfield Town Council, voluntarily registered the land within
its ownership under the provisions of Section 15(8) of the 2006
Act, following which, the application was advertised in line with
statutory requirements (insofar as it affected the remaining land).
During the consultation period, an objection was submitted by the
owner of that land.
The framework for the decision is set out in the accompanying
Decision Report, which analyses the evidence submitted in support
of the application and considers relevant case law. An opinion has
also been sought from counsel. Having taken all of this into
account, it is recommended that the application is accepted, and
the land registered as a green.
