Decision published: 11/11/2021
Effective from: 11/11/2021
Decision:
In 2020, Hampshire County Council received an
offer for the dedication of public footpath rights on a development
site known as ‘Top Field’ by Drew Smith Homes
Ltd, which at the time owned the land over which the routes run.
The routes provide links to and between other footpaths recorded
through diversion orders made by
Winchester City Council (WCC) under Section 257 of the Town and
Country Planning Act 1990 earlier that year. The routes to be
dedicated, which are shown on the accompanying Location Map, were
to be dedicated under Section 25 of the Highways Act 1980, at a
width of 1.5 metres. Authority for the County Council to enter into
this agreement was granted at officer level in March
2020.

Decision Maker: Director of Culture, Communities and Business Services
Decision published: 11/11/2021
Effective from: 11/11/2021
Decision:
Following the earlier determination of an
application for a Definitive Map Modification Order to record
public footpath and bridleway rights in Penton Mewsey:
• The unrecorded footpaths between Points A-B and Points E-F
should be extinguished under the provisions of s118 of the Highways
Act (1980).
• The unrecorded footpath which runs across a field between
Points B-C should be diverted to the field edge between those
points under the provisions of s119
of the Highways Act (1980).
• The unrecorded footpath between Points B-D should be
retained and recorded by a Definitive Map Modification Order under
s53 of the Wildlife and
Countryside Act (1981).
• In accordance with the previous determination, the width of
the route between Points B and C should be 1.5 metres
• Part of the historic and variable width of the unrecorded
footpath between Points B-D should be extinguished under the
provisions of s118 of the Highways Act (1980), leaving a footpath
with a width of 1.5 metres.
Lead officer: Jonathan Woods
Decision Maker: Director of Culture, Communities and Business Services
Decision published: 11/11/2021
Effective from: 11/11/2021
Decision:
That, following the acceptance of the
Definitive Map Modification Order (DMMO) application to record
Chawton Bridleway 4 as a restricted byway, authority is given to
extinguish the majority of the historic and currently
unrecorded width.
The remaining route will be a 3-metre-wide bridleway with four
passing places with a width of between 4 and 5 metres. A DMMO will
subsequently be made to
record the route as a restricted byway, following the determination
of the application in March 2021.

To consider a report of the Director of
Children's Services - North Baddesley Infant School is a community
school currently approved to take children of school age from Year
R to Year 2. The PAN for the school is currently 90 with maximum
capacity of 270. The governing body of the school is seeking
to:
(a) Lower the school age range to 2-year-olds; and
(b) Directly manage a new early years’ facility as part of
the school.
The school leadership team has reviewed its management, financial
and operational arrangements, and the governors at its meeting on
24 June 2021 gave full agreement to the proposal.
The school has previously offered the childcare opportunity to the
open market. This resulted in only one interested provider who went
through the selection process; however, they have chosen not to
take up the opportunity to deliver the childcare provision. The
school has not considered to offer it out again due to the poor
response previously.
The lowered age range will be accommodated in the multi-purpose
building which is currently sited on the school campus which has
full facilities to accommodate younger children. The accommodation
was successfully purchased and installed via a community grant and
the remaining costs were supported by the school who recognised the
demand for wrap around care by their working parents.
There is no cost to Hampshire County Council associated with this
proposal.
A public consultation was held from 3 September to 1 October
2021.
There have been three objections raised and these have been
resolved.
